1. Agreement to Terms

By accessing this website, requesting a quote, approving a proof, or placing an order with Fresh Baked Prints, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our website or place an order.

Fresh Baked Prints may modify these Terms at any time. Changes are effective when posted on our website. Your continued use of the website or placement of orders after changes are posted constitutes your acceptance of the revised Terms.

You represent that you are at least 18 years of age and have the authority to enter into this agreement on behalf of yourself or the business you represent.

2. Color Accuracy

We strive to reproduce colors as accurately as possible. However, exact color matching is not guaranteed. Color appearance can vary due to, without limitation:

  • Monitor or device calibration and brightness
  • Lighting conditions
  • Material or substrate type

Ink, coating, and print process variation Digital proofs, online previews, and mockups are approximations only and are not a guarantee of the final printed result.

3. File Preparation & Quality Check

Our Quality Check process is focused on technical print readiness, including:

  • File size and dimensions
  • Resolution and pixelation
  • Bleeds and margins (where applicable)

We do not review or correct:

  • Spelling, grammar, or punctuation
  • Layout, design choices, or content placement
  • Legal, regulatory, or brand compliance

You are solely responsible for reviewing and approving all artwork, text, and content prior to submission and proof approval.

Once an order is approved and moved into production, no changes, edits, or corrections can be made.

4. Turnaround Times

All stated turnaround times are estimates, not guarantees. We make reasonable, good‑faith efforts to meet requested deadlines, but delays can occur due to, including but not limited to:

  • Equipment malfunction, maintenance, or technical issues
  • Weather, power outages, or supply shortages
  • Natural disasters, labor disruptions, or other events beyond our reasonable control
  • High order volume or capacity constraints

Same‑Day and Rush Orders:

“End of day” completion for same‑day or rush orders may range from approximately 5:30 PM to 8:30 PM, depending on workload and production capacity.

If equipment issues require parts or extended repair, we may, at our discretion, outsource production to a trusted local partner to complete your order. If we choose to do this to meet a rush deadline, no additional rush fees will be charged for that outsourcing.

Please note: many vendors and carriers have limited hours or close early on Fridays, which may affect delivery or pickup timing.

5. Production, Cancellations & Changes

Once you have approved your order (including any proof, quote, or invoice) and it has been entered into production:

No edits, changes, or design revisions are permitted.

No cancellations, credits, or refunds are allowed, except as specifically stated in Section 7 (Warranty, Returns & Refunds).

Duplicate, accidental, or incorrect orders resulting from customer actions are the responsibility of the customer.

6. Outsourcing Rights

Fresh Baked Prints may, at its sole discretion, outsource any order or portion of an order to verified print partners or vendors to ensure quality, efficiency, or timely completion.

Our partners are expected to operate under confidentiality obligations and professional standards consistent with our own practices.

7. Warranty, Returns & Refunds

Because our products are custom‑made, all sales are final.

If Fresh Baked Prints makes a clear and identifiable production error, we will reprint the affected items as your sole and exclusive remedy. Production errors may include, for example:

  • Incorrect quantity
  • Incorrect size or material from what was approved
  • Print not matching the approved proof (e.g., wrong file or version printed)

To qualify for a reprint, you must:

  1. Notify us within 48 hours of pickup or delivery.
  2. Provide clear photos of the issue and packaging.
  3. Return the product or make it available for inspection if requested.

We do not reprint, refund, or credit for:

  • Spelling, grammar, punctuation, or content errors in customer‑supplied files
  • Low‑resolution, pixelated, or poor‑quality images supplied by the customer
  • Color differences between on‑screen previews and final prints (see Section 2)
  • Minor imperfections or variances that are within standard commercial print tolerances
  • Delays or damage caused by third‑party carriers or shipping providers (see Section 8)

We reserve the right to determine, in good faith, whether an issue qualifies as a production error under these Terms.

Nothing in this Section is intended to limit any non‑waivable consumer rights you may have under applicable law.

8. Shipping, Pickup & Delivery

You are responsible for providing accurate and complete shipping and contact information.
Incorrect or incomplete addresses may result in additional shipping charges, delays, or non‑delivery; such additional costs are the customer’s responsibility.

Once an order:

  • Leaves our facility with a third‑party carrier, or
  • Is picked up by you or your representative,

title and risk of loss pass to you, and the order is deemed delivered and accepted subject to your right to submit a claim under Section 7 within 48 hours.

We are not responsible for:

  • Delays, loss, or damage caused by third‑party carriers
  • Missed deadlines or events due to carrier delays

We will, where reasonably practical, assist you with information needed to file a claim with the carrier.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall Fresh Baked Prints, its owners, members, managers, employees, or agents be liable for:

  • Any indirect, incidental, special, punitive, or consequential damages
  • Lost profits, lost revenue, loss of business, or missed events
  • Any claims arising from or related to your use of our website, products, or services

Our total aggregate liability, for any claim and for any cause whatsoever, shall be limited to the amount actually paid by you for the order in question.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

10. Customer Content & Intellectual Property

By uploading, submitting, or otherwise providing artwork, images, logos, text, or other content (“Customer Content”) to Fresh Baked Prints, you:

  1. Represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use, reproduce, and have us print the Customer Content.
  2. Represent and warrant that your Customer Content does not:
    • Infringe any copyright, trademark, or other intellectual property right
    • Violate any right of privacy or publicity
    • Contain defamatory, obscene, harassing, discriminatory, hateful, or otherwise unlawful material
    • Violate any applicable law or regulation

You remain the owner of your Customer Content. We do not claim ownership of your designs or files solely by virtue of printing them for you.

You agree to indemnify, defend, and hold harmless Fresh Baked Prints from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including
reasonable attorneys’ fees) arising out of or related to:

  • Any allegation that your Customer Content infringes or violates the rights of any third party
  • Any alleged defamation, misrepresentation, or reputational harm resulting from your Customer Content
  • Your breach of these Terms or any applicable law

Fresh Baked Prints is not liable for defamation, misrepresentation, or reputational damage resulting from customer‑supplied content.

We reserve the right (but have no obligation) to refuse, remove, or cancel any order we reasonably believe involves prohibited or inappropriate content.

11. Payment & Processing

All orders must be paid in full before production begins, unless otherwise agreed in writing.

We accept major credit/debit cards and business checks. For check payments, production does not start until the check has cleared.

Payment information is processed securely by our payment processors. We store only limited information (such as the last four digits of a card) for verification and reference purposes, not full card numbers.

You authorize Fresh Baked Prints to charge your selected payment method for all amounts due in connection with your order, including applicable taxes, fees, and approved changes.

12. Technical Difficulties

We are not responsible for website downtime, internet outages, data loss, or other technical issues outside our reasonable control.

You are responsible for maintaining backup copies of your artwork and files before uploading them. We are not obligated to store or archive your artwork or order files after completion,
though we may do so for a limited time for reorders or internal reference.

13. Marketing & Photography Rights

Fresh Baked Prints may, from time to time, photograph or record printed materials that we produce (excluding personal or confidential information) and may use these images for:

  • Marketing and advertising
  • Social media content
  • Portfolio or sample displays (online or in print)

If your project is confidential or subject to a non‑disclosure requirement, you must notify us in writing before production or request and sign an appropriate NDA.

If you later request that we remove or stop using a particular image featuring your project, we will make reasonable efforts to honor that request on a go‑forward basis where practical.

14. Refusal of Service

We reserve the right, in our sole discretion and as permitted by law, to:

  • Refuse service
  • Cancel orders (with appropriate refund or credit where required)
  • Suspend or terminate access to our website or services

This includes situations where we reasonably believe that:

  • Customer Content is unlawful, harmful, or violates these Terms
  • The order may expose us or others to legal liability or reputational harm
  • There is abuse, harassment, or unreasonable conduct toward our staff

15. Governing Law & Venue

These Terms, and any disputes arising out of or relating to them, your order, or your use of our website or services, shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict‑of‑law principles.

You agree that the state and federal courts located in Oakland County, Michigan shall have exclusive jurisdiction and venue over any such disputes, and you consent to the personal jurisdiction of those courts.

16. Entire Agreement & Acknowledgement

These Terms, together with any written quote, invoice, or order confirmation issued by Fresh Baked Prints, constitute the entire agreement between you and Fresh Baked Prints regarding your order and supersede any prior or contemporaneous communications. By submitting an order, approving a proof, or using this website, you acknowledge that you have read, understood, and agree to these Terms.

16. Data Sharing

Customer data is not shared with 3rd parties for promotional or marketing purposes.

Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

17. Messaging Terms and Conditions

By providing your phone number and agreeing to receive texts, you consent to receive text messages from Fresh Baked Prints, from 888-327-4137 regarding account notifications, customer care, delivery notifications, marketing. Consent is not a condition of purchase. Message frequency varies. Message & data rates may apply. You can reply STOP to unsubscribe at any time or HELP for assistance.
